The ruling of residing in a country of disbelievers for a necessity

The question:
A sister concluded the legal and civil act with a Muslim brother who is born in France and has French citizenship. Among the reasons why he stays in France is to take care of his ill mother, he also promised her to change his residence to a Muslim country. So, is it permissible for him to reside in a country of disbelievers in such conditions and is it permissible for her to go with him with the intention of going away when the conditions fit? May Allah reward you with good.
The answer:
All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.
We have no doubt that living in a country of disbelievers poses a danger to the faith, behaviors and manners of the Muslim. Saying that travelling and living in a country of disbelievers is not permissible for a person who is not secure from temptation, or who lacks knowledge of his religion, or who is not able to show the ritual practices of his religion in a complete way, is the saying which is safer for his faith and for his protection from melting in the disbelieving society and in order to not fall in its pitfall of corruption and destruction.
However, it will be permissible if the Muslim is able to manifest his faith and the ritual practices of his religion openly, like performing prayers, fasting, performing hajj, the Friday prayer, the congregational prayers and other Islamic rites, and in case he can maintain the creed of Al-Walâ' and Al-Barâ' (alliance and disavowal), by avoiding loving the disbelievers or feeling loyalty to them. He should rather hate them and disapprove of their deeds, since loving the enemies of Allah requires agreeing with them, following and approving of their deeds; and this, of course, goes against the creed of Al-Walâ' and Al-Barâ' which is the most trustworthy handhold of Islam that will never break.
Allah عزَّ وجلَّ said:
﴿لاَ تَجِدُ قَوْمًا يُؤْمِنُونَ بِاللهِ وَالْيَوْمِ الآخِرِ يُوَادُّونَ مَنْ حَادَّ اللهَ وَرَسُولَهُ وَلَوْ كَانُوا آبَاءَهُمْ أَوْ أَبْنَاءَهُمْ أَوْ إِخْوَانَهُمْ أَوْ عَشِيرَتَهُمْ﴾ [المجادلة : 22].
The meaning of the verse:
You (O Muhammad صلَّى الله عليه وسلَّم) will not find any people who believe in Allâh and the Last Day, making friendship with those who oppose Allâh and His Messenger (Muhammad صلَّى الله عليه وسلَّم), even though they were their fathers, or their sons, or their brothers, or their kindred (people).﴿ [Al-Mujâdila (The Woman Who Disputes): 22].
Allah عزَّ وجلَّ also said:
﴿وَمَنْ يَتَوَلَّهُمْ مِنْكُمْ فَإِنَّهُ مِنْهُمْ﴾ [المائدة: 51].
The meaning of the verse:
And if any amongst you takes them as Auliyâ' (friends, protectors, helpers), then surely he is one of them﴿ [Al-Mâ'ida (The Table Spread with Food)].
The Prophet صلَّى الله عليه وسلَّم said: “Whoever imitates any nation then he is from amongst them”(1). The Prophetصلَّى الله عليه وسلَّم also said: “Everyone will be with whomever he loves (on the Day of Judgment)”(2). The Muslim who lives in a country of disbelievers should also know the rulings of his religion so as to allow him to preserve it and be secure from temptation, deviation from the right way.
Hereupon, if these norms are established, it will be permissible for him to reside there according to the need of his mother of medical care, as the person who takes care of a sick person is concerned by the same rulings, especially if he is weak and cannot leave this country because of medical, geographical or political reasons.
Moreover, the wife has the same rulings as her husband since she is under his authority, as the jurisprudential rule stipulates: “That which is subordinate follows under the ruling of the original”. The wife has the right to make as a condition during the marriage contract the fact of not traveling with her to such countries (of disbelievers), and “Muslims are to abide by the conditions upon which they agreed (with one another)”(3).
It should be also known that the residence (in a country of disbelievers) which is not linked with a legal necessity or need is among the greatest harms and dangers upon the faith of the Muslim, as residing with disbelievers may lead to imitate them, and imitating them in their customs, attitudes, behaviors and characters, in addition to what they declare of rulings which go against what Allah عزَّ وجلَّ has revealed and other polytheist practices; all this may lead the Muslim to be like them, as the Prophet صلَّى الله عليه وسلَّم declared: “Anyone who associates with a polytheist and lives with him is like him”(4). This hadith, though judged by some scholars as being weak, its meaning is correct, as its meaning is close to that of the hadith “He who copies any people is one of them” as well as the one who loves them and approves of them.
Ibn Taymiyya رحمه الله said: “The narrowest meaning we can understand from this hadith is that it is forbidden to imitate the disbelievers, although this hadith indicates that the person who imitates disbelievers is considered a disbeliever, in accordance with Allah’s عزَّ وجلَّ saying:
﴿وَمَنْ يَتَوَلَّهُمْ مِنْكُمْ فَإِنَّهُ مِنْهُمْ﴾ [المائدة: 51].
The meaning of the verse:

Concerning the ruling of keeping a disbeliever mother company

Question:
What is the ruling of residing with a disbeliever mother?
Answer:
All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.
The mother should be obeyed and treated with goodness and kindness. We should also consort with her kindly even though she is a disbeliever but with disavowing her Shirk (ascribing partners to Allah) and trying to invite her to Islam. This should be the case with all the relatives. In fact, hating disbelievers and polytheists does not mean that it is permissible to wrong them whether by words or acts, Allah عزَّ وجلَّ said:
﴿وَإِنْ جَاهَدَاكَ عَلَى أَنْ تُشْرِكَ بِي مَا لَيْسَ لَكَ بِهِ عِلْمٌ فَلاَ تُطِعْهُمَا وَصَاحِبْهُمَا فِي الدُّنْيَا مَعْرُوفًا﴾ [لقمان: 15].
The meaning of the verse:
But if they (both) strive with you to make you join in worship with Me others that of which you have no knowledge, then obey them not, but behave with them in the world kindly﴿ [Luqmân: 15].
Allah عزَّ وجلَّ also said:
﴿وَاعْبُدُوا اللهَ وَلاَ تُشْرِكُوا بِهِ شَيْئًا وَبِالْوَالِدَيْنِ إِحْسَانًا وَبِذِي الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينِ وَالْجَارِ ذِي الْقُرْبَى وَالْجَارِ الْجُنُبِ وَالصَّاحِبِ بِالجَنْبِ وَابْنِ السَّبِيلِ وَمَا مَلَكَتْ أَيْمَانُكُمْ﴾ [النساء: 36].
The meaning of the verse:
Worship Allâh and join none with Him in worship, and do good to parents, kinsfolk, orphans, Al-Masâkin (the poor), the neighbor who is near of kin, the neighbor who is a stranger, the companion by your side, the wayfarer (you meet), and those (slaves) whom your right hands possess﴿ [An-Nissâ' (The Women): 36].
The Prophet صلَّى الله عليه وسلَّم told the man who came to him to ask who of people is more entitled to be treated with the best companionship: “Your mother”. The man said: “Who is next?”. The Prophet صلَّى الله عليه وسلَّم said: “Your mother”. The man said: “Who is next?”. The Prophet صلَّى الله عليه وسلَّم said: “Your mother”. The man said: “Who is next?”. The Prophet صلَّى الله عليه وسلَّم said: “Your father”(1).
Thereupon, the hate of disbelievers does not prevent from acquitting their rights and behave with them properly; Allah عزَّ وجلَّ said:
﴿لاَ يَنْهَاكُمُ اللهُ عَنِ الَّذِينَ لَمْ يُقَاتِلُوكُمْ فِي الدِّينِ وَلَمْ يُخْرِجُوكُمْ مِن دِيَارِكُمْ أَنْ تَبَرُّوهُمْ وَتُقْسِطُوا إِلَيْهِمْ إِنَّ اللهَ يُحِبُّ الْمُقْسِطِينَ﴾[الممتحنة: 8].
The meaning of the verse:
Allâh does not forbid you to deal justly and kindly with those who fought not against you on account of religion nor drove you out of your homes. Verily, Allâh loves those who deal with equity.﴿ [Al-Mumtahana (The Woman to be examined): 8].

The required condition of traveling to a country of disbelievers

Question:
I am a brother who emigrated from France to Algeria with my family one year ago. Until now, I have not found a job. So, is it permissible for me to travel to France for a period of three months at the most in order to work?
Answer:
All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.
It is permissible for a person to travel to a country of disbelievers in order to work or trade provided that he knows his religion, that his religion be in security, that he will be capable of performing the rites of Islam completely and be capable of applying the principle ofAl-Walâ' and Al-Barâ' (loyalty and friendship vs. disavowal and enmity). However, if his religion is not in security and he is not capable of showing the rites of Islam in a complete way, it is not permissible for him to travel to these countries for fear of feeling loyalty to disbelievers and loving them.

Concerning the celebration of the New Year’s Day

Question:
What is the opinion of Islam as regards what is known by “Happy New Year”? May Allah reward you with good.
Answer:
All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.
Firstly, it is important to notice that Islam has not opinions in the questions of fiqh (jurisprudence) and creed as it is mentioned in your question, like the religious schools and sects, but Islam has legal rulings which are manifested in its proofs and signs. Moreover, know that every deed by which we want to be near Allah should be in accordance with His Sharia and His Prophet’s صلَّى الله عليه وسلَّم practices, taking into account quantity, manner, place and time which are determined by the Sharia. If this conformity is not realized, the innovations which the Prophet صلَّى الله عليه وسلَّم warned us against by saying: “Avoid novelties, for every novelty is an innovation, and every innovation is an error and every error is in Hell”(1). Indeed, Allah عزَّ وجلَّ said:
﴿وَمَا آتَاكُمُ الرَّسُولُ فَخُذُوهُ وَمَا نَهَاكُمْ عَنْهُ فَانْتَهُوا وَاتَّقُوا اللهَ إِنَّ اللهَ شَدِيدُ الْعِقَابِ﴾ [الحشر: 7].
The meaning of the verse:
And whatsoever the Messenger (Muhammad صلَّى الله عليه وسلَّم) gives you, take it, and whatsoever he forbids you, abstain (from it)﴿ [Al-Hashr (The Exile, the Banishment): 7].He عزَّ وجلَّ also said:
﴿فَلْيَحْذَرِ الَّذِينَ يُخَالِفُونَ عَنْ أَمْرِهِ أَنْ تُصِيبَهُمْ فِتْنَةٌ أَوْ يُصِيبَهُمْ عَذَابٌ أَلِيمٌ﴾ [النور: 63].
And let those who oppose the Messenger’s (Muhammadصلَّى الله عليه وسلَّم) commandment (i.e. his Sunnah legal ways, orders, acts of worship, statements, etc.) (among the sects) beware, lest some Fitnah (disbelief, trials, afflictions, earthquakes, killing, overpowered by a tyrant, etc.) befall them or a painful torment be inflicted on them.﴿ [An-Nûr (The Light): 63].
The celebration of the birthday of the Christ is not different from the celebration of that of the Prophet صلَّى الله عليه وسلَّم, since it is known by people that this did not exist at the time of the Prophet صلَّى الله عليه وسلَّم, nor that of his Companions or during the Three Best Generations. Certainly, all that was not considered as religion at the time of the Prophet صلَّى الله عليه وسلَّم and his Companions cannot be considered today a religion, as the Imam Mâlik رحمه اللهnoticed, who said also : “Whoever introduces an innovation into Islam thinking that it is good, is implying that Muhammad betrayed his mission, because Allah عزَّ وجلَّ says:
﴿الْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِي وَرَضِيتُ لَكُمُ الإِسْلاَمَ دِينًا﴾ [المائدة: 3].
...This day, I have perfected your religion for you, completed My Favor upon you, and have chosen for you Islam as your religion...﴿ [Al-Mâida (The Table Spread with Food): 3].
In addition, such deed is inherent to the traditions of Christians among people of the Scriptures whom the Sharia prevented us from following, by the texts ordering to contradict them and not imitate them. That is why we should stick to the Book and the Sunna as regards creed, knowledge and deed, because it is the only way to do away with innovations and their harmful effects.

The ruling concerning reading the Gospel and the Torah

The question:
What is the ruling about reading the Gospel and the Torah and what about the authenticity of the suspicion attributed to Sheikh Al-Islâm that he used to read them?
The answer:
All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.
It is not permissible to read the books in which truth and falsehood are mingled in order to avoid any evil which could be resulted from reading them and which can affect the faith of the Muslims. People seeking the truth will find it in the two trusty and sure references which are: the Book and the Sunna, as truth cannot be out of these.
Besides, the Prophet صلَّى الله عليه وسلَّم warned against the books of People of the Book (The Jews and the Christians) as in the story of `Umar Ibn Al-Khattâb رضي الله عنه who came to the Prophet صلَّى الله عليه وسلَّم with a book he brought from some People of the Book, so the Prophet صلَّى الله عليه وسلَّم got angry and said: “Are you in doubt of it, O Ibn Al-Khattâb? By the One in Whose Hand is my soul, I have brought to you that which is white and pure. Do not ask People of the Book, lest they inform you about something true but that you will deny or something false that you will believe. By the One in Whose Hand is my soul, if Mûssaعليه السلام (Moses) were alive, he would have definitely followed me”(1).
Besides, if someone has knowledge of the Book and the Sunna and needs to make the religion triumphant and make the Word (Islam) of Allah to be superior by studying deeply the books of deviant and innovator people who follow their desires and the scholastics with the aim of criticizing them, unwrapping their errors and showing their contradictions; in such case, this is permissible for the erudite scholar as Sheikh Al-Islâm Ibn Taymiyya رحمه الله did, by refuting the books of logicians and philosophers, he also studied the books of the Rafidites (Ar-Râfida) of the Shiite sect and criticized them in his book: “Minhâj As-Sunna An-Nabawiyya”. Moreover, Ibn Taymiyya رحمه الله showed the contradictions of the different Gospels and the deviance of Christians as regards their creed.

Acquiring the disbelievers nationality

The Question:
I am an Algerian young man; religiously upright (If Allah سبحانه wills). I have lived in Canada for a long time and I try to leave it as soon as possible. But I do not have a residence to settle down in my country.
So, is it permissible to get the Canadian passport (with some conditions I will mention later on) since it enables me to leave this country and enter the Gulf States and try to settle there?
And here are the conditions:
First: Indeed getting the Canadian passport will not invalidate my Algerian nationality but it will be the original one, this is confirmed by their laws and the Algerian country accepts plurality of nationalities.
Second: I am able to renounce this passport whenever I want, without having problems. This is also confirmed by their laws.
Third: I can avoid the oath of respecting the Queen, her children and the King as long as I sit in the back of the room without uttering a word.

The answer:
All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till The Day of Resurrection.
It is not allowed to acquire the disbelievers’ nationality even with keeping the original one, because of the negative aspects which affect the Muslim’s religion and creed. It is enough to know what results from implicit contentment in applying the disbelievers’ customs and laws of that country, besides referring to them as judges and showing pride in being a Canadian citizen and all what engenders; in terms of allegiance and friendship toward them and imitating them in their words and deeds. This contradicts the completeness of faith or nullifies it, according to the situation. Allah تعالىsaid:
﴿لاَ تَجِدُ قوْمًا يُؤْمِنُوْنَ بِاللهِ وَاليَوْمِ الآخِرِ يُوَادُّونَ مَنْ حَادَّ اللهَ وَرَسُولَهُ وَلَوْ كَانُوا آباءَهُمْ أَوْ أَبْنَاءَهُمْ أَوْ إِخْوَانَهُمْ أَوْ عَشِيرَتَهُمْ…﴾[المجادلة: 22].
Translation of the meaning of the verse:
You (O Mohammad صلَّى الله عليه وسلَّم) will not find any people who believe in Allah and the Last Day, making friendship with those who oppose Allah and His Messenger (Mohammad صلَّى الله عليه وسلَّم), even though they were their fathers or their sons or their kindred (people)…﴿ [Al-Mujâdilah (The Woman Who Disputes): 22].
So, the Muslim is called to complete his religion and increase his faith in calling to Allah تعالى and showing Islam.

And among the conditions of traveling to the country of disbelief is to manifest the religion and reveal its rites in a complete way without any opposition to any of them; with the capacity of being loyal to the Muslims and disavowal to the disbelievers. And those who are not able to do so are obliged to go back to the place they came from and try hard to look for a job and get satisfied with littleness and ask Allah for success. He is the Best Helper and the Best Provider.

Determining the forbidden shape of the cross

The question:
Is the emblem on the front and back of a Mercedes and a Chevrolet considered a cross? Is it an obligation for me to remove it, even if this results in a decrease in the car’s value? May Allah give you the success to explain the legal ruling for this issue. May Allah reward you abundantly.
The answer:
All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.
Not every emblem that resembles a cross is prohibited and forbidden. The cross is the one known that the Christians sanctify and extol by way of worship. In most cases, this symbol appears on right angles and the bottom is larger than the top. The Christians consider the cross a distinguished symbol of following `Îssa Ibn Maryam (Jesus son of Mary)(1).
Thereupon, it is not permissible for a Muslim to raise an item that carries this image, because this is a symbol ofShirk (polytheism). The cross symbolizes worship to other than Allah. Whoever resembles a people in their practices is just like them. This comes from the hadith where the Prophet صلَّى الله عليه وسلَّم said, “Whoever imitates a people is like them…”(2).
Whenever a Muslim possesses this kind of cross, he should remove it whether by defacing it, blotting it, sticking on it, or by any other way to remove this symbol, without damaging the principal object that bears it. This is based on the hadith reported by `Imrâne Ibn Hittân that `Aisha رضي الله عنها told him, “The Prophet’s صلَّى الله عليه وسلَّم used to destroy everything that carried a cross or image in his house.”(3)
Ibn Hajar said, “Since destroying images and crosses is intended in this hadith, then defacing, scratching off, and spoiling them as well is included. This is the act that should be done to all images, including images engraved in a wall.”(4)
If the person does not have the ability to change it with his hands then he must use any other means at his disposal. This is taken from the hadith where the Prophet صلَّى الله عليه وسلَّم said, “Whoever witnesses something evil must change it with his hands if he has the ability, otherwise he must speak against it. If he is not able to speak against it, he must hate it in his heart. Hating this evil in the heart is the weakest of faith.”(5)
Now that we have defined the cross that the Christians venerate and take as a symbol, it is clear that the symbols on the two previously mentioned cars are not to be removed.
The perfect knowledge belongs to Allah عزَّ وجلَّ. Our last prayer is all praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon our Prophet, his Family, his Companions and Brothers till the Day of Resurrection.

(1There are many kinds of crosses: Saint George’s cross, Saint Andrew’s cross, the cross of Lorraine, the Maltese cross, the cross of the Catholic Church, Saint Anthony’s cross, Jerusalem cross, the swastika and others.
